You need to review the UDRP system

Hello Andreia,

I am afraid you have misunderstood ICANN's role. We have no ability or authority to change or adjust ownership or otherwise of domain names.

What ICANN has done is help create a system called the Uniform Dispute Resolution Process (UDRP) for trademark holders who feel their trademark has been infringed by a domain name.

You can find the relevant details here:

In brief, you will need to contact a UDRP provider (list at: http://www.icann.org/dndr/udrp/approved-providers.htm) and file a complaint through them. They will then consider the case and if the other party is found to have unfairly infringed your trademark, they will instruct the domain registry to turn over the domain to you.
